Copyright Policy

All games hosted on GameBits are submitted by developers and publishers who represent and warrant that they have the necessary rights to distribute the content. GameBits requires that:

• Games must not infringe on trademarks, copyrights, or other intellectual property rights of third parties

Verification Process

GameBits implements a multi-stage content verification process:

• Initial Review: All submitted games undergo initial review for obvious copyright violations and trademark infringements
• Developer Verification: Developers must verify their identity and agree to our Terms of Service and content submission guidelines
• Automated Screening: We use automated tools to detect potential copyright violations including trademarked names and assets
• Community Reporting: Users can report suspected copyright violations through our reporting system
• Regular Audits: We conduct periodic audits of our game catalog to ensure ongoing compliance

DMCA Takedown Notice

If you believe that your copyrighted work has been infringed upon on our platform, you may submit a DMCA takedown notice with the following information:

Required Information:

1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works
2. Identification of the infringing material: A description of where the material that you claim is infringing is located on our platform (including the URL or game title)
3. Contact information: Your address, telephone number, and email address
4. Good faith statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
5. Accuracy statement: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
6. Physical or electronic signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest

How to File a DMCA Notice

Send your DMCA takedown notice to our designated Copyright Agent:

Response to DMCA Notices

Upon receipt of a valid DMCA notice, GameBits will:

• Acknowledge receipt of the notice within 48 hours
• Remove or disable access to the allegedly infringing content promptly
• Notify the content provider of the takedown
• Document all notices and responses for our records

If we remove content in response to a DMCA notice, we will make a good faith effort to contact the content provider and provide information about the takedown notice and the counter-notification process.

Counter-Notification

If you believe that content you posted was removed by mistake or misidentification, you may file a counter-notification with our Copyright Agent with the following information:

• Your physical or electronic signature
• Identification of the content that has been removed and the location where it appeared before removal
• A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
• Your name, address, telephone number, and email address
• A statement that you consent to the jurisdiction of the federal court in your location, and that you will accept service of process from the person who filed the original DMCA notice

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If that party does not file a court action within 10-14 business days, we may restore the removed content.

Repeat Infringer Policy

GameBits has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Trademark Policy

In addition to copyright protection, GameBits respects trademark rights. If you believe that a game or content on our platform infringes your trademark rights, please contact us at legal@gamebits.io with:

• Description of your trademark and registration information (if applicable)
• Description of the allegedly infringing content and its location on our platform

Developer Responsibilities

By uploading content to GameBits, developers represent and warrant that:

• They own all rights to the content or have obtained all necessary licenses and permissions
• The content does not infringe on any third-party intellectual property rights
• They have the authority to grant GameBits the license described in our Terms of Service
• They will promptly respond to any copyright or trademark claims related to their content

Developers who violate copyright or trademark laws may have their content removed and their accounts suspended or terminated.

Fair Use

GameBits recognizes that certain uses of copyrighted material may constitute fair use under copyright law. We will consider fair use principles when evaluating DMCA notices and may decline to remove content that we believe constitutes fair use. However, we reserve the right to make the final determination on all such matters.

International Copyright

GameBits operates globally and respects international copyright laws and treaties. We will respond to valid copyright notices from copyright holders in any jurisdiction, in accordance with applicable international agreements and local laws.

Modifications to This Policy
